For construction and subcontracting debts, the Building Industry Fairness (Security of Payment) Act 2017 (BIF Act) is the critical instrument. The BIF Act creates a statutory adjudication process for payment claims under construction contracts, bypassing ordinary litigation timelines. It applies to contracts for construction work and related goods and services, and it gives subcontractors a faster mechanism to recover progress payments from head contractors. The National Credit Code does not apply to B2B lending or trade credit, so commercial debt collection is regulated primarily through ASIC's debt collection guidelines and Queensland's own fair debt collection standards.
